Remediation plans / concepts after carrying out investigations relevant to contaminated sites

WHAT-WE-DO: In Germany, remediation plans or concepts are often required, especially for larger construction projects, following the completion of a preliminary, contaminated site investigation. For our clients throughout Germany, we at MuP-Group draw up both remediation concepts based on the BBodSchV and remediation plans in accordance with § 13 BBodSchV. The main difference for the client between a remediation plan or concept is that a remediation plan is declared binding by the competent authority.

A remediation plan/concept essentially involves the definition of remediation areas and on-site soil management. As soon as preliminary investigations of contaminated sites cannot rule out hazards due to high levels of pollutants for groundwater, humans or plants, the areas must be remediated. The areas are localised in advance by means of a detailed investigation so that the extent of the damage is known. These areas are identified in the remediation plan/concept and graphically depicted in the form of sections. The contaminated masses are also determined. In addition, health and safety measures are discussed in order to avoid accidents during the earthworks.

Furthermore, soil management is addressed in a remediation plan/concept. This involves the internal relocation of soil on a site. The development plan is decisive in the case of the installation of soil material. Higher LAGA classifications may be incorporated under sealed surfaces than in green areas, for example. However, this also depends on the local conditions - such as the groundwater table distance - and is discussed in advance with the responsible authority.

The remediation plan/concept also addresses shortfalls in the event of a possible raising of the upper edge of the soil. The installation values are also addressed here. If necessary, an additional authorisation under water law must be obtained for the external delivery of soil materials.
