New version of TA Luft adopted to limit pollutant emissions

On 23 June 2021, the new version of the TA Luft was adopted by the cabinet. It will replace the 2002 version from autumn 2021 and adapts the regulations to EU standards and the current state of the art with regard to requirements for installations subject to approval under the Federal Immission Control Act (BImSchG). The TA Luft is therefore a key instrument for reducing emissions and immissions of air pollutants from installations requiring authorisation.

To date, around 50,000 plants, e.g. from the metal production, chemical and waste treatment industries, are already subject to the regulations of the BImSchG. The new version adds further areas such as biogas and shredder plants as well as factories for the production of wood pellets to the list of plants requiring authorisation and defines corresponding requirements for these plants.

With the new TA Luft, stricter requirements regarding ammonia and particulate matter emissions will come into force for large livestock facilities, in which 70 % of the ammonia and particulate matter emissions in the exhaust air must be filtered in future. This is necessary because ammonia emissions make a relevant contribution to the over-fertilisation and acidification of biotopes. Furthermore, ammonia from agriculture contributes 25 - 50 % to pollution from secondary particulate matter (PM2.5).

However, in order to improve animal welfare, it was determined that housing methods such as outdoor climate stables can be used even if they lead to higher emissions than closed systems. However, considerations show that lower emissions can be expected due to lower temperatures in outdoor climate stables and different functional areas.

The TA Luft 2021 also includes a new nationwide regulation to protect residents from disturbing odours from neighbouring plant operations.
